this might be a dumb question, but is it really legal to sample audio (vocals or anything else) from a movie or game and use it in a track that will be released on a label?

if you have the right to do so (ask the publisher/studio) then yes
otherwise i think non-commercial use is legal to a certain degree (free releases etc)

It's only illegal if you get caught.

Actually, it would probably depend on a courts interpretation of the copyright law, were it to go that far. While I believe all works are covered by the same laws, common sense would suggest that they may be implemented differently for different types of media. For example, using an audio clip from a film in a musical composition is very different to using the same clip as audio in another movie. At least that's the way I'd look at it. But I'm no authority on the subject.

At the end of the day, legal or illegal, I'd imagine it would be highly unlikely that a publisher would drag a nobody into court for copyright infringement. It'd be different if you were Kanye West and made a million bucks off a #1 single with an uncleared sample, but you'd get nought out of any DJ who isn't David Guetta or Tiesto or someone. That said, I suppose any charges would be not against the artist, but the label (which is probably in a very different position financially).

I dunno... I guess that to put it simply- you're not breaking the law if nobody important cares. It only becomes a problem when you get rich off somebody else's hard work.

I think it was something with 16 or 8 seconds constantly is kind of free to use?! But otherwise you mention the other artist et cetera or with a release some of the money goes to the participating party...

Wrong, sorry but this is a nothing more than an urban myth. Copyright laws are different in every country and constantly changing due to the fast moving pace of todays media, so if you plan on sampling something, a quick mail to your national licensing organization (for UK check out PPL) to find out the do's and don't's can save you a lot of trouble down the line.

We get a lot of demo's through with copyrighted material we just can't sign due to the fact that you need permission to use it, and that comes at a cost!

You can however release a cover version of something, as long as your re-record the vocal or the part you sample and/or credit the original artist, so that for example PPL can obtain royalties for that artist automatically. Movies and games you need to contact not only the director of the film/game, but also the studios, actors and anyone else possibly involved in it, again this is at a cost!

At the moment, free releases seem to be fair game, and hopefully that continues! Also you have the public domain which can be sampled from freely as well as some youtube videos (be careful though as video licensing companies may also be involved), as well as the millionssss of sample packs out there. Look past vengeance and trailer voices, there are some really great ones out there. Or get a mic and record your own! Add's more elements of fun to producing

For me, sampling is a big part of dance music and its sad that its now gotten to the stage were you can end up paying out big amounts of compensation for misuse of someone else's recordings.

You can take a risk, but its on your head!
